Here in Brazil, there are basically three types of resignation requests that an employee can make, these are the following:

Resignation by agreement
Since the 2017 Labor Reform , it is possible to terminate an employee's employment by mutual agreement, when both the employer and the employee reach a consensus on the termination of the employment contract. In this case, the employee is entitled to half of the notice period, proportional vacation and proportional 13th salary, but cannot withdraw the FGTS or receive the 40% fine on the FGTS balance.

This type of payment occurs when the employer decides to terminate the employment contract due to a serious misconduct committed by the employee, such as dishonesty, insubordination, habitual drunkenness, among others. In this case, the employee loses the rights to receive advance notice, vacation and proportional 13th salary , in addition to not being able to withdraw the FGTS.

How much is the fine if I resign?
While this is an unpleasant situation for any employer, it is important to be aware of the financial consequences if an employee decides to resign without giving notice . This practice, also known as “ quitting without paying notice ,” can result in fines and additional charges for the company.

Brazilian labor law states that when resigning, the employee must serve a notice period , which varies according to the length of service provided to the company. If the employee does not serve this period, he or she must pay compensation to the company, equivalent to the amount he or she would receive during the notice period.
