It is not the law that pushes society and the market forward. It is society and the market themselves that push each other forward. The law most commonly deals with these advances when some adjustments are necessary, between determinations and prohibitions. The State follows suit and, precisely for this reason, our Constitution recognizes free initiative as a social value (article 1, IV), in dialectical pair with work. The State apparatus is bureaucratic and rarely displays effective and useful creativity like private entities in their daily efforts to face their challenges, find paths, solve problems: optimize, evolve, develop.
And none of this is strange to the Law: much of what is bulk sms services in ghana developed has legal implications (such as new types of business), if not is legal in itself. Creative lawyers were, are and will be useful. And increasingly so, in fact. This is what we seek to demonstrate in our latest book: Legal Structuring of Companies : there are millions of companies that need the intervention of a lawyer for their own security and success.
It is not a question of bending or distorting the Law, but of recognizing the legitimate spaces for lawful progress. It is not uncommon for nothing more than the adaptation of something that constituted innovation abroad and is replicated here. This is the case of the consolidation among us of corporate law: a broad and dynamic space for professional practice that is already consolidated abroad, namely in North America and Europe, but which is still narrow-minded among us Brazilians. Of course, this is a neologism – we did not create it, however – that seeks to translate not only the focus on Corporate Law , but a proactive stance in relation to legal entities and their legal structuring, expanding the use of legal technology for the benefit of corporations. And this is a challenge that, contrary to what one might think, is measured by its results, allowing for immediate responses.
